Privacy Policy

Your data, and what we do with it.

This Privacy Policy describes how Regular Holding LLC, a New York limited liability company (“Regular Holding,” “we,” “us,” or “our”), collects, uses, discloses, and protects information in connection with the Atlas platform (“Atlas” or the “Platform”). This Privacy Policy is incorporated into the Atlas Terms of Service by reference.

Atlas is a business-to-business platform. This Privacy Policy applies to representatives, employees, and agents of our business customers (“you” or “your”) who access or use the Platform.

1. Information We Collect

1.1 Account Information. When you register for Atlas, we collect information about you and your business, including:
  1. business legal name, formation jurisdiction, and entity type;
  2. names, titles, email addresses, and phone numbers of authorized users;
  3. business address and tax identification number; and
  4. login credentials.
1.2 Payment and Billing Information. We collect information necessary to bill your subscription and facilitate payment processing through the Platform, including:
  1. bank account numbers, routing numbers, and account holder information;
  2. billing contact name, address, and email;
  3. payment transaction details, including amounts, dates, counterparty information, and authorization records; and
  4. payment confirmations and return or chargeback records.
1.3 Governance and Recordkeeping Data. We collect and store data you submit through Atlas governance and workflow features, including board and management approvals, supporting documentation, and audit trail records.
1.4 Usage Data. We automatically collect information about how you interact with the Platform, including:
  1. IP address, browser type, device identifiers, and operating system;
  2. pages viewed, features used, and actions taken within the Platform;
  3. dates and times of access; and
  4. referring URLs and search terms.
1.5 Communications. We collect information you provide when you contact us, including emails, support requests, and feedback.
1.6 Information from Third Parties. We may receive information about you or your business from third-party payment providers, identity verification services, fraud prevention services, and publicly available sources.

2. How We Use Your Information

2.1 We use the information we collect for the following purposes:
  1. to provide, operate, and maintain Atlas, including governance, recordkeeping, and payment-processing functionality;
  2. to process your subscription payments and facilitate payment transactions through third-party payment infrastructure;
  3. to transmit payment instructions to applicable third-party payment providers for processing;
  4. to maintain approval records, audit trails, and transaction confirmations;
  5. to verify your identity and your business's eligibility;
  6. to comply with NACHA Operating Rules, applicable payment provider terms, and applicable law;
  7. to detect, investigate, and prevent fraud, unauthorized transactions, and other prohibited activity;
  8. to enforce our Terms of Service and Acceptable Use Policy;
  9. to communicate with you about your account, transactions, and Platform updates;
  10. to improve and develop the Platform; and
  11. to comply with legal obligations, respond to legal process, and cooperate with regulatory authorities and law enforcement.

3. How We Share Your Information

3.1 Third-Party Payment Providers. We share payment transaction data, account information, and authorization records with third-party payment providers and their partnered financial institutions as necessary to process payment transactions you initiate through Atlas. These providers process your information under their own terms and privacy policies.
3.2 Service Providers. We share information with service providers who perform services on our behalf, including hosting, analytics, customer support, identity verification, and fraud prevention. These providers are contractually obligated to use your information only to perform services for us and to maintain its confidentiality.
3.3 Compliance and Legal Obligations. We may disclose your information to regulators, law enforcement, courts, or other governmental authorities as required by law, regulation, legal process, NACHA Operating Rules, or payment provider requirements. This includes responding to subpoenas, court orders, or regulatory inquiries.
3.4 Business Transfers. In the event of a merger, acquisition, reorganization, sale of assets, or bankruptcy, your information may be transferred to the successor entity. We will notify you of any such transfer that materially changes the handling of your information.
3.5 With Your Consent. We may share your information for other purposes with your written consent.
3.6 No Sale of Personal Information. We do not sell personal information to third parties.

4. Data Retention

4.1 We retain your information for as long as your account is active, and thereafter as necessary to:
  1. fulfill the purposes described in this Privacy Policy;
  2. comply with legal, regulatory, and contractual retention obligations, including NACHA Operating Rules requiring retention of authorization and transaction records for a minimum of two (2) years;
  3. resolve disputes and enforce our agreements; and
  4. maintain business records in accordance with applicable law.
4.2 When information is no longer required for any of the above purposes, we will delete or de-identify it in accordance with our data retention procedures.

5. Data Security

5.1 We maintain commercially reasonable administrative, technical, and physical safeguards designed to protect your information from unauthorized access, disclosure, alteration, and destruction. These safeguards include encryption of sensitive data in transit and at rest, access controls, and regular security assessments.
5.2 No method of transmission or storage is completely secure. We cannot guarantee absolute security and are not liable for unauthorized access resulting from circumstances beyond our reasonable control.
5.3 You are responsible for maintaining the security of your account credentials and for all activity under your account.

6. Cookies and Tracking Technologies

6.1 We use cookies, pixels, and similar tracking technologies to operate the Platform, remember your preferences, analyze usage, and improve performance.
6.2 Essential Cookies. Required for the Platform to function, including session management and authentication. These cannot be disabled.
6.3 Analytics Cookies. Used to understand how you interact with the Platform so we can improve it. You may disable analytics cookies through your browser settings, though some Platform functionality may be affected.
6.4 We do not use cookies to serve third-party advertising on the Platform.

7. Your Rights and Choices

7.1 Access and Correction. You may access and update your account information through the Platform at any time. To request a copy of the personal information we hold about you, contact us at hi@regularholding.com.
7.2 Deletion. You may request deletion of your personal information by contacting us at hi@regularholding.com. We will comply with your request to the extent permitted by law, but we may retain information as necessary to comply with legal obligations, resolve disputes, maintain transaction records required by NACHA Operating Rules, and enforce our agreements.
7.3 Communications. You may opt out of promotional emails by using the unsubscribe link in those emails. You cannot opt out of transactional and account-related communications.
7.4 State Privacy Rights. If you are a resident of a state with applicable privacy legislation, including California, you may have additional rights regarding your personal information, such as the right to know, delete, correct, and opt out of certain processing. To exercise these rights, contact us at hi@regularholding.com. We will verify your identity before processing any request and respond within the timeframes required by applicable law.

8. Children's Privacy

8.1 Atlas is a business-to-business platform and is not directed to individuals under the age of 18. We do not knowingly collect personal information from anyone under 18. If we learn we have collected such information, we will delete it promptly.

9. Third-Party Links and Services

9.1 The Platform may contain links to third-party websites or services, including those of payment providers. We are not responsible for the privacy practices of those third parties. We encourage you to review their privacy policies before providing them with your information.

10. Changes to This Privacy Policy

10.1 We may update this Privacy Policy at any time by posting the revised version on the Platform and updating the Effective Date. Material changes will be communicated via email or in-Platform notice at least thirty (30) days before taking effect. Your continued use of Atlas after the effective date of a modification constitutes acceptance.
